Please take notice that the Applicant, Kellogg Street 80 Funding LLC, has applied to the Planning Board of the Borough of Edgewater, for Preliminary and Final Site Plan Approval with bulk variances to permit the use of the building and property located at <a href="http://maps.google.com/maps?f=q&amp;source=s_q&amp;hl=en&amp;geocode=&amp;q=280+Old+River+Road,+Edgewater,+NJ&amp;sll=37.0625,-95.677068&amp;sspn=73.420101,52.910156&amp;ie=UTF8&amp;hq=&amp;hnear=280+Old+River+Rd,+Edgewater,+Bergen,+New+Jersey+07020&amp;ll=40.81344,-73.987792&amp;spn=0.004417,0.003229&amp;t=h&amp;z=18" target="_blank">280 Old River Road</a>, as and for a child care center. The property which is the subject of this application is designated as Block 88, Lot 11 on the Tax Assessment Map of the Borough of Edgewater. In 2005, Block 88, Lot 11 received subdivision approval from the Borough of Edgewater which resulted in the subdivision of Lot 11 into three (3) separate lots: Lot 11.01, Lot 11.02 and Lot 11.03. This subdivision was perfected by deed which was recorded on May 5, 2006 in the Office of the Clerk of Bergen County in Deed Book 9072 at Page 304. The subdivided lot which is the subject of this application is Lot 11.01. Although the subdivision was perfected by the filing and recording of a deed as heretofore set forth, the Tax Assessment Map has not to date been updated to reflect the perfected subdivision. As such, the Tax Assessment Map of the Borough of Edgewater continues to designate the lot which is the subject of this application as Lot 11.<br />
<br />
A hearing on this application will be held on August 23, 2010 at 7:00 p.m. at the Borough of Edgewater Municipal Building located at 916 River Road, in Edgewater, New Jersey 07020. At the public hearing, you may appear in person or by agent or attorney and raise questions or offer comment with respect to this application.<br />
<br />
The property which is the subject of this application is located in the Shadyside Mixed Use District in the B-2 Zone, where child care centers, such as proposed by the Applicant, is a permitted use. The Applicant seeks relief from the strict enforcement of the Land Use and Development Regulations of the Borough of Edgewater as they pertain to child care centers as follows:<br />
<br />
Section 249-99C requires a Minimum Lot Area of 25,000 square feet whereas the existing lot area is approximately 10,471 square feet and the proposed lot area is approximately 10,471 square feet.<br />
Section 249-99C requires a Minimum Lot Width of 100 feet whereas 80.60 feet exists and 80.60 feet is proposed.<br />
Section 249-99C requires a Minimum Lot Depth of 150 feet whereas 127.60 feet exists and 127.60 feet is proposed.<br />
Section 249-99C requires a Minimum Front Yard Setback of 20 feet whereas zero (0) feet exists and zero (0) feet is proposed.<br />
Section 249-99C requires a Minimum Side Yard Setback of 10 feet whereas 0.70 feet exists and 0.70 feet is proposed.<br />
Section 249-99C requires a Minimum Rear Yard Setback of 40 feet whereas 16.90 feet exists and 16.90 feet is proposed.<br />
Section 249-99C requires a Maximum Building Coverage of 40% whereas 77.5% exists and 77.5% is proposed.<br />
Section 249-99C requires a Maximum Impervious Coverage of 75% whereas 92.8% exists and 96.3% is proposed. The existing Impervious Coverage of 92.8% may remain unchanged depending upon the choice of material for the playground area. If the material chosen is an impervious material, then the variance sought is to allow impervious coverage of 96.3% instead of the existing 92.8%. The lot area, lot width, lot depth, front yard setback, side yard setback, rear yard setback, building coverage and impervious coverage are existing, nonconforming lot features and Applicant does not seek to increase these nonconformities except as described above with respect to Maximum Impervious Coverage. <br />
Section 249-99C(3) requires 48 parking spaces must be provided for the proposed use and Section 249-96(E) requires that the parking spaces be located on the lot on which the principal use is located. Parking for the child care center is proposed to be provided in the easily accessible municipal parking lot located across Thompson's Lane.<br />
<br />
Please take further notice that the Applicant requests that the application be deemed amended to include, and the Planning Board grant, any and all other variances, exceptions, waivers, interpretations and/or incidental relief from the requirements of the Borough of Edgewater Land Use and Development Regulations or other Borough Ordinances determined to be necessary during the review and processing of this application.<br />

PLEASE TAKE NOTICE that on August 11, 2010 at 6:00 P.M. at the Council Chambers, Municipal Building, 916 River Road, Edgewater, New Jersey, the Planning Board of the Borough of Edgewater will hold a public hearing on an application filed by i.Park Edgewater LLC for Amended Preliminary and Final Subdivision Approval and Amended Site Plan Approval with respect to the property designated as Block 99, Lots 1, 3, 4 and 5 on the Tax Map and commonly known as 45 River Road. The property is situate in the SWR Zone and is part of a larger Redevelopment Area pursuant to the adoption of Ordinance 1349-2006 by the Mayor and Council of the Borough of Edgewater on September 18, 2006. <br />

NOTICE TO BE PUBLISHED IN OFFICIAL NEWSPAPER<br />
BOROUGH OF EDGEWATER<br />

PLEASE TAKE NOTICE that on June 28, 2010 at 7:00 P.M. at the Council Chambers, Municipal Building, 916 River Road, Edgewater, New Jersey, the Planning Board of the Borough of Edgewater will hold a public hearing on an application filed by i.Park Edgewater LLC for minor subdivision approval to subdivide the property designated as Block 99, Lot 1 on the Tax Map and commonly known as 45 River Road, creating a 36,166 square foot parcel on the northern side to be conveyed and annexed to the adjacent Block 96, Lot 3.02 (115 River Road). The property is situate in the SWR Zone and is part of a larger Redevelopment Area pursuant to the adoption of Ordinance 1349-2006 by the Mayor and Council of the Borough of Edgewater on September 18, 2006. <br />

No new construction or roadways are proposed, and the application does not request variance relief. However the Applicant will seek any and all variances, variations, waivers and interpretations as the Board and/or its professionals may consider to be required. <br />
<br />
The application and plans are on file in the Office of the Planning Board, Municipal Building, 916 River Road, Borough of Edgewater. The records are available for inspection from 8:30 a.m. to 4:00 p.m. daily. <br />
<br />
Any interested party may appear at said hearing and participate therein in accordance with the rules of the Planning Board.<br />
